Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ApiTrinity platform and services ("Service") provided by ApiTrinity B.V. ("ApiTrinity", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

ApiTrinity is a software-as-a-service (SaaS) platform that enables users to create, manage, and publish API documentation. The Service includes a visual block editor, OpenAPI specification import, static site generation, hosting, and related features as described on our website.

3. Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• One person or legal entity per account; sharing accounts is not permitted
• You must notify us immediately of any unauthorized use of your account

4. Subscription & Billing

ApiTrinity offers a free tier and paid subscription plans. By subscribing to a paid plan:

• You agree to pay the fees associated with your selected plan, as displayed on our pricing page
• All prices are in Euros (EUR) and exclude applicable taxes unless stated otherwise
• Paid plans are billed monthly or annually, depending on your selection
• Subscriptions auto-renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time; access continues through the end of the current billing period
• Refunds are not provided for partial billing periods
• We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any unlawful, harmful, or fraudulent purpose
• Upload content that infringes third-party intellectual property rights
• Attempt to gain unauthorized access to the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Resell or redistribute the Service without our written consent

6. Intellectual Property

ApiTrinity and its licensors retain all rights, title, and interest in the Service, including all software, designs, trademarks, and documentation. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.

You retain ownership of all content you create or upload through the Service (including API specifications, documentation text, and media). By using the Service, you grant ApiTrinity a limited, non-exclusive license to host, display, and process your content solely for the purpose of operating and providing the Service.

7. Data & Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in the Privacy Policy.

8. Uptime & Service Levels

We strive to maintain high availability of the Service. For Free, Starter, and Pro plans, availability is provided on a best-effort basis. Enterprise plan customers receive a 99.9% uptime Service Level Agreement (SLA) as detailed in their enterprise agreement.

We may perform scheduled maintenance with reasonable advance notice. Emergency maintenance may be performed without notice when necessary to protect the Service or its users.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• ApiTrinity shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to ApiTrinity in the 12 months preceding the claim
• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied

10. Termination

• You may terminate your account at any time by contacting us or using the account settings
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• Your content will be available for export for 30 days after termination, after which it may be permanently deleted
• Provisions that by their nature should survive termination (including liability limitations, intellectual property, and governing law) will remain in effect

11. Governing Law

These Terms are governed by the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts in Amsterdam, The Netherlands.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or through the Service. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
